Abstract: To achieve a comprehensive well-off society，pace of rural well-off is must accelerated，especially for process of urbanization in rural areas in China.In process of urbanization，there has been a series of ecological problems，such as environmental pollution，destruction of ecological environment in rural areas is more serious，and this is due to insufficient attention to rural areas environmental problems in the process of urbanization，which will further affect our living environment and people′s health，and even affect the realization of a well-off society in an all-round way.Based on analyzing present situation of rural ecological environment legislation in China，institutional defects of rural ecological environment protection was further analyzed，relevant legal opinions and suggestions were put forward，so that，ecological protection has been solved in process of rural urbanization in China.
